Understanding Your Responsibilities as a Client

Just as clients are entitled to certain rights, they also share responsibilities that help ensure a productive and effective attorney–client relationship. These responsibilities are grounded in mutual respect, cooperation, and honesty, forming the foundation of successful legal representation. Clients play an essential role by providing accurate information, following their lawyer’s guidance, and communicating promptly about any changes or developments related to their case.

Fulfilling these responsibilities allows your lawyer to represent you efficiently, ethically, and within the boundaries of the law. The list below outlines the key expectations for clients under the Statement of Client’s Responsibilities, as adopted by the Administrative Board of the Courts of the State of New York.

1. The client is responsible for treating the lawyer and the lawyer’s staff with courtesy and consideration.
2. The client is responsible for honoring the fee arrangement agreed to with the lawyer, in accordance with law.
3. The client is responsible for being truthful in all discussions with the lawyer and for providing all relevant information and documentation concerning the matter.
4. The client is responsible for being cooperative with the lawyer and for responding promptly to requests for information.
5. The client is responsible for attending all scheduled appointments and court appearances and for being on time.
6. The client is responsible for keeping the lawyer informed of any developments or changes in the case, including change of address or telephone number.
7. The client is responsible for reading all documents, including retainer agreements and correspondence, and for asking questions if anything is not understood.
8. The client is responsible for understanding that the lawyer must respect and abide by the law and professional rules of conduct.
9. The client is responsible for understanding that the lawyer cannot guarantee results in any matter.
10. The client is responsible for following the lawyer’s advice and making decisions on important matters after carefully considering the lawyer’s recommendations.
